RE: Federal Guidance on Parental Consent Question
Good Afternoon Participating School District,
We have asked the U.S. Department of Education for some clarification on the revised parental consent regulations (CFR §300.154 (d)(2)). I received a response this morning (see below) to one of the questions asked, and wanted to pass this information along to you. The response clarifies that the Written Notification and Parental Consent Form may be presented to the parent at the same time, for instance included in the same mailing, or handed out together at an IEP meeting, etc.
We will be providing additional guidance as it becomes available. Thank you for your patience!
~Jennifer

Hi Jennifer.
During our conversation yesterday, you indicated that your first question below is time sensitive. In response to that question, the public agency may provide the parent with the written notification form and the consent form at the same time (e.g., at the same IEP Team meeting; in the same mailing). Our office will provide you with a formal response to all of your questions as soon as possible. Thank you for your patience.--Laura
