Hi All,

 

I had a great question from a district, and I thought I would share the question and answer with you.

 

Question: May an LEA mail the notification of rights and form for parental consent in the same mailing?

 

Answer:  Three Parts!

 

  1. LEAs may send the notification of parental rights and request for parental consent in the same mailing.  This is compliant because it allows the parent to have a reasonable amount of time to ask questions and provide informed consent.
  2. LEAs may provide the parents a notification of parental rights and form to provide parental consent at an IEP team meeting.  However, the school may NOT ask or require the parent to provide consent at the IEP team meeting.  The district must allow the parents to take the information home, and give the parent reasonable time to ask questions and provide informed consent.
  3. A best practice may be to provide the notification of rights with the invitation to attend the IEP team meeting, and then provide the consent form to the parent at the IEP team meeting.  The LEA could ask the parent to sign it at the meeting if the parent has had a reasonable time to review the notification of rights prior to the meeting.
